Welcome to LakeviewNOLA.org and the Lakeview New Orleans app (the “Service”). By accessing or using the Service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

The Service provides a platform for residents and friends of the Lakeview neighborhood in New Orleans, LA, to connect, share information, and participate in community activities. The Service includes social networking features, discussion forums, event listings, and more.

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

4. User Accounts

To access certain features of the Service, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain the security of your account by keeping your password confidential.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

5. User Conduct

You agree not to use the Service for any unlawful or prohibited activities, including but not limited to:

• Posting obscene, vulgar, or offensive content.

• Campaigning from a personal account. Campaigning must be done on a dedicated page for the campaign.

6. Advertising and Solicitation

• Users are not allowed to advertise services outside of official posting boards within the website.
• Companies, organizations, or public entities running pages dedicated to their organization, company, or services may share their services, specials, and generally solicit within their dedicated page.

7. Blocking and Flagging

• Users have the ability to block each other. Any user who is blocked by three users will receive an automated suspension until their actions are reviewed.
• Users can flag comments, groups, documents, photos, videos, and other forms of content, including other members, for violations of the community policies.
• Any content or user that receives three flags will receive an automated suspension until the content or user is reviewed by an administrator.

8. Payments and Subscriptions

• Some services on the Service may require payment or subscriptions.
• We offer organizations the ability to offer subscriptions to their content.
• We handle the administration of payment collection for these organizations but do not warranty their services, content delivery, or hold any liabilities related to them.
• Users acknowledge that while we provide the platform and facilitate payment collection, we are not responsible for the content posted by users or organizations.

9. Content

You retain ownership of the content you post on the Service. However, by posting content, you grant the Service a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, modify, and distribute your content.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information.

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service. We also reserve the right to ban any users for breaking these terms and policies without a refund.

Privacy Policy

1. Introduction

Welcome to Dave Mudek – Adventure Advisor and the Dave Mudek – Adventure Advisor app (the “Service”). Your privacy is important to us. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service. By using the Service, you agree to the collection and use of information in accordance with this policy.

Payment information is collected through the app via payment processor integrations and is not stored locally. It is securely stored with third-party payment processors such as Apple Pay, Google Pay, PayPal, Klarna, and others.

When visitors leave comments on the site, we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help with spam detection. An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here. After approval of your comment, your profile picture is visible to the public in the context of your comment.

4. Use of Information

We use the information we collect to:

• Provide and manage your access to the Service
• Process payments for paid services
• Send notifications and marketing communications within the app
• Improve user experience and the functionality of the Service

We do not sell personal information or app interactions to third parties.

5. Sharing of Information

If you request a password reset, your IP address will be included in the reset email.

Users are responsible for maintaining strong passwords and not sharing personal information with unknown parties. Our team will never ask for your payment information or passwords directly.

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Visitor comments may be checked through an automated spam detection service.

10. How Long We Retain Your Data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website, we store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

11. Children’s Privacy

We do not knowingly collect personal information from children under the age of 13. The Service is intended for users aged 17 and older. If we learn that we have collected information from a child under age 13, we will delete that information as quickly as possible.

12. International Users

For users outside the United States, your information may be transferred to, stored, and processed in the U.S. By using the Service, you consent to such transfer, storage, and processing. We comply with international data protection laws, including GDPR, to the extent applicable.
